DraftKings and FanDuel left Nevada after a regulatory conflict over prediction-market products. Their withdrawal leaves WSOP.com as the state’s only online poker operator.

Nevada’s online poker structure shifted again as DraftKings and FanDuel formally stepped away from the state. Their withdrawal removes any immediate competition for WSOP.com and confirms that Nevada will continue with a single regulated operator for the foreseeable future.

The exit follows a direct clash with state regulators about the future of prediction-market products. Each company opted to step back from its Nevada licensing rather than halt its national expansion plans.

Regulators Approve Both Exits

The Nevada Gaming Control Board confirmed two key actions last week. It accepted Flutter’s surrender of FanDuel’s registration and granted DraftKings’ request to withdraw all pending filings.

The NGCB stated that both companies intended to offer sports event contracts that the state views as illegal. Regulators noted that the planned prediction-market features conflict with Nevada’s rules and cannot coexist with a Nevada license.

FanDuel CEO Peter Jackson told investors that the company needed to prioritize its broader product plans while acknowledging Nevada’s position.

How Prediction Markets Created the Standoff

Prediction-market platforms allow users to trade contracts tied to outcomes in politics, sports, or economic events. They operate under federal oversight from the Commodity Futures Trading Commission and sit between financial-style trading and gambling.

Nevada takes a different view. The state classifies these markets as unlicensed sports event wagering. Regulators issued warnings, cease-and-desist notices, and repeated reminders that sports-event contracts violate Nevada law.

This left DraftKings and FanDuel unable to pursue prediction-market growth while holding a Nevada license, making withdrawal the only viable option.

Impact on Nevada’s Online Poker Landscape

With both operators gone, Nevada becomes a one-site market anchored by WSOP.com. No major operator has an active application. There is no clear timeline for new entrants.

PokerStars remains blocked due to long-standing licensing issues tied to legacy conflicts. DraftKings’ Electric Poker ambitions will not reach Nevada as long as prediction markets remain the priority. 

BetMGM allowed its Nevada waiver to lapse, and BetRivers has little incentive to enter a market without online casino revenue.

For players, the reality is straightforward. Nevada stays a single-operator state unless regulatory interpretations change or operators shift their strategic priorities.
